Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.162 of 2021, pending before the learned 5th Additional District & Sessions Judge, Bhubaneswar, arising out of Khandagiri P.S. Case No.215 of 2019, for alleged commission of offences under Sections 307/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 5th Additional District Judge, Bhubaneswar, by order dated 30.09.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account that the petitioner has assaulted the Home Guard on duty, this Court is not inclined to entertain this bail application.

Accordingly, the BLAPL stands rejected.
