This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the petitioner and Mr. S.S. Kanungo, learned Addl. Government Advocate for the State. 3.

In this case, Commissioner-cum-Secretary to the Government in Revenue & Disaster Management Department is liable to comply with the order dated 12.02.2013 passed by the learned Odisha Administrative Tribunal, Bhubaneswar in O.A. No.812 of 2008. The order has not yet been complied. The order sheet shows, several times, it has been contended by the State that, the matter of compliance of the aforesaid order is in active consideration of the appropriate Government. The compliance affidavit filed earlier has been rejected vide order dated 23.08.2021.

In view of such fact, the present incumbent is directed to comply with the order passed by the learned Tribunal in O.A. No.812 of 2008, within a period of three months from the date of receipt of a copy of this Order. If the order is not complied, the petitioner is at liberty to file fresh contempt petition for disobedience of the Order of this Court.
