Heard learned counsel for the Parties.

There is no dispute in the Bar that the Petitioner's case is covered in the decision of this Court in WPC(OAC) No.822 of 2014. As a consequence, this Court remits the matter back to the Opposite Party No.2 to consider the case at hand in the light of the judgment in WPC(OAC) No.822 of 2014 and release all consequential remedy. Dependent on the outcome in further process of determination, Petitioner's pension aspect may also be worked out by completing the entire exercise within a period of two months.
