This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 26.07.2021 in connection with Puri Town P.S. Case No.142 of 2021 corresponding to G.R. Case No.1687 of 2021 pending in the Court of learned S.D.J.M., Puri for the alleged commission of offence under Sections 341/294/323/353/386/387/506/307/ 120(B)/34 of IPC read with Section 25 of Arms Act. 4.

It is submitted that out of five accused persons in the case three have been released on bail. It is further submitted that there is nothing on record to show that the present petitioner stands at a different footing than the said co-accused persons who have released on bail.

Having regard to the submissions made, the materials on record, the period of detention already undergone and the fact that similarly situated co-accused persons have been released

on bail, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
