This matter is taken up through virtual/physical mode. 2.

The Original Application No.140 (C) of 2016 was filed before the Odisha Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 140 of 2016.

The Petitioner was being continuing as Assistant Teacher in a Government Primary School under Deogarh District filed the writ petition, the Petitioner has aggrieved by cancellation of sanction of Assured Career Progression/ Revised Assured Career Progression in favour of the Petitioner.

None appears for the Petitioner at the time of hearing today 4.

Mr. Nilambar Jena, learned Standing Counsel appearing for the School and Mass Education Department brought to the notice of this Court that the Petitioner had filed

// 2 // W.P.(C) No.33264 of 2020, wherein it has prayed for as follows:- "xx xx xx xx Issue a writ of Mandamus directing the Opposite Party No. 6 to transmit the case records of O.A. No. 140(C)/2016 to this Hon'ble Court for withdrawal of the said original application in view of Govt. letter dated 15.10.2020 under Annexure-2."

For better appreciation of Annexure-2, the text of Annexure-2 is extracted hereunder:

"I am directed to say that pursuant to the order dt.20.12.2018 of Hon'ble High Court passed in OJC No.644/2000 filed by the State of Odisha and another vrs. Sri Arjuna Charan Mohanty & another, Government in S &ME Department after due consultation with Government in Law Department vide UOR No.19/1dtd.04.01.2019 have decided in regularize the services of the irregularly appointed Primary School Teachers made by late K.C. Guru, EX-Inspector of Schools in the year 1997and continuing as such, pursuant to the orders of Hon'ble OAT dtd.10.03.2000 in O.A. No.2583(C)/1999 & batch of cases on the following grounds:

1. Those Primary School Teachers, who are continuing in service and receiving full salary shall be considered for their regularization to enable them to get TBA/ACP/RACP promotion and all pensionary benefits. 2.

Those candidates, who had been terminated by the then Director, Elementary Education, Odisha and out of service till date shall not be allowed to join. Director, Elementary Education, Odisha is hereby authorized to implement the order after thorough verification of each individual cases and upload the same in the ILMS Software after due compliance."

In view of the letter dated 15.10.2020, therefore, nothing remains for adjudication in this writ petition. 7.

Accordingly, the writ petition stands disposed of. (M.S. Raman) Judge Jyostna
