1. 1. This matter is taken up through Hybrid Mode. Order No

2. The Petitioner has filed the present Writ Petition with the following prayer.

"To declare that the return of the proposed for sanction of pension as at Annexure-10 is unsustainable in law.

To declare that the pay fixation made vide order under Annexure-7 is valid in law and in accordance with Govt. Resolution at Annexure-5 To direct the respondents to sanction and pay the final pension and other pensionary benefits as per Annexures-7 & 8 forthwith."

It is submitted by the learned counsel for the State that during pendency of the matter, the Opp. Parties have already complied the objections raised by the Controller of Accounts and has resubmitted the pension paper for sanction of pension by allowing the TGT scale of pay w.e.f 3.5.2007.

In view of the above, nothing remains to be decided in the present writ petition.

However, since no body has appeared on behalf of the petitioner, the Writ Petition is dismissed for nonprosecution. (Biraja Prasanna Satapathy) Judge
