2. Heard learned counsel for the Petitioner.

The petitioner has filed this writ petition with the following prayer:- "The Hon'ble Tribunal may graciously be pleased to direct the respondents to fix the scale of pay of the Applicant at Rs.9,300/-- 34,800/-(PB-2) with Grade Pay Rs.4,600/- w.e.f 1.1.208 in accordance with order dated 18.11.2009 of Hon'ble OAT, Bhubaneswar passed in O.A. No.624 of 2003 and as per office order dated 11.2.2013 of Govt. of Odisha School & Mass Education Department.

The Hon'ble Tribunal made graciously pleased to direct the respondents to pay the differential pay, D.A, Pension, Gratuity and other service benefits forthwith The Hon'ble Tribunal may graciously be pleased to direct the respondents to pay the un-utilized Leave Salary for 262 days to the Applicant forthwith.

The Hon'ble Tribunal may graciously be pleased to direct the respondents to pay interest @ 18% per annum on the above amount from the date of superannuation till the date of actual payment of the above dues.

// 2 // Necessary direction may be issued to the respondents to consider the case of the applicant for grant of service benefits within a time to be stipulated by this Hon'ble Tribunal.

The Petitioner has moved before Opposite Party No.3 seeking redressal of his grievances as made in the representation under Annexure-7 to the Writ Petition.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs Opposite Party No.3 to take a decision on the above noted representation of the petitioner in accordance with law, within a period of three months from the date of receipt of certified copy of this order and communicate the result thereof to the Petitioner.

With the aforesaid observation and direction the Writ Petition is disposed of.
