Heard learned counsel for the petitioner and learned counsel for the State.

Mr. Purushottam Pradhan, learned counsel engaged by the legal aid has appeared in the matter.

The petitioner is an accused in connection with Spl. G.R. Case No.133 of 2022, pending in the file of the learned Additional Sessions Judge-cum-PO Spl. Court under POCSO Act, Sundargarh, arising out of Bisra P.S. Case No.100 of 2022, for alleged commission of offences under Sections 323/376(3)/506 of IPC read with Section 4 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned A.D.J.-cum-PO Special Court under POCSO Act, Sundargarh, by order dated 12.10.2022 in the aforementioned case, the present BLAPL has been filed.

Considering the statement of the victim and the medical examination report, this Court is not inclined to entertain this bail application.

Liberty is granted to the petitioner to renew his prayer before the learned Court in seisin after examination of the victim, which shall be considered on its own merits.

7.

Accordingly, the BLAPL stands rejected.
