27.7.2022 1 1. This matter is taken up through hybrid mode.

2. The writ petition has been registered before this Court on 28.12.2022 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Cuttack.

3. On perusal of the available order sheets of the learned Tribunal it is indicated that notices were issued on 7.3.2018. The matter was never taken up/pursued thereafter nor there is any further pleading by any of the parties.

4. Counter on behalf of the OPs- S&ME Department is on record.

5. The O.A. was filed in the year 2016 by the applicant with a prayer to be appointed as Regular Primary School Teacher after completion of six years in service as Sikshya Sahayak w.e.f. 23.8.2014.

6. None appears for the petitioner when the matter is called.

7. Learned Standing Counsel has referred to the paragraph-8 of the counter filed before the learned Tribunal which is quoted herein :

"That in the mean while the applicant Jahnamani Dei also submitted a declaration before District Project

Coordinadtor, SSA, Puri (Resp.No.4 to O.A.) through Block Education Officer, Kanas which has been submitted vide Lt. No.71 dtd 12.01.18 that, her service has already been regularized w.e.f. 23.08.14 vide Order No. 9325 dtd 26.09.17 of Collector-cum-CEO, Zilla Parishad, Puri which has been communicated by District Education Officer, Puri vide Memo No. 9326 dtd 26.09.17, so she wants to withdraw the instant O.A. case. For better appreciation of this Hon'ble Court the copy of declaration made by the applicant is herewith annexed as Annexure-B/4.

8. It is, therefore, submitted after regularization of service of the petitioner w.e.f. 23.8.2014, nothing would survive for adjudication by this Court.
