This matter is taken up by virtual/physical mode. 2.

The Petitioner has challenged the Office order No. 48204 dated 9.12.97 issued from Directorate of Secondary Education, Orissa, Bhubaneswar, whereby the Petitioner being considered as surplus T.G. Teacher consequent upon posting of Headmaster was transferred to Narangarh Girls High School, by way of writ petition i.e. OJC No. 17921 of 1997. The said case being transferred to Orissa Administrative Tribunal, and thereafter retransferred to this Court, the said writ petition has been renumbered as WPC(TAC) 80 of 2015.

Mr. Sakti Sekhar, counsel appearing on behalf of Mr. Budhadev Routray, Senior Advocate for the Petitioner submits that he has no up-to-date instruction in the matter. However, Mr. Nilamber Jena, Standing Counsel appearing for the Department of School and Mass Education points out that in

// 2 // the year 1997 when the writ petition was filed, the Petitioner has disclosed his age as 38 years and by now she must have been retired from her service on attaining superannuation and the matter has become infructuous.

In view of the aforesaid submission, the writ petition is disposed of as infructuous.
