27.7.2022 1 1. This matter is taken up through hybrid mode.
2. The writ petition has been registered before this Court on 28.12.2022 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Cuttack.
3. On perusal of the available order sheets of the learned Tribunal it is indicated that notices were issued on 30.3.2016. The matter was thereafter listed on about fourteen occasions and never taken up/pursued after 12.9.2018. There is no further pleadings by any of the parties.
4. The O.A. was filed in the year 2016 challenging the corrigendum dated 8.11.2017 published in the daily "Dharitri" by challenging the minimum age for application to the post of ANM from 21 years to 18 years.
5. Learned AGA referring to the averments made in the petition as well as the annexures, submits that prescription of a minimum age as per the statutory rules/policy of 18 years, cannot be faulted with in any manner and the scope of judicial review of fixing a minimum age is very limited. It is further submitted that the petitioner being otherwise eligible to apply for the post having attained the prescribe minimum age of eighteen years, she cannot have any grievance.
6. It is further submitted that the cause of action would not survive due of long lapse of time.
