This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioners and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Puri Sadar P.S. Case No.363 of 2021 corresponding to G.R. Case No. 3173 of 2021 pending in the Court of learned Nyayadhikari, Grama

// 2 // Nyayalaya, Puri for commission of alleged offences under sections 498-A, 304-B,406/34 of the Indian Penal Code and section 4 of the Dowry Prohibition Act. Perused the F.I.R. annexed to the anticipatory bail application.

Learned counsel for the State as per the order dated 11.05.2022 has furnished the instruction and submitted that no charge sheet has been submitted against petitioner no.2 Sakhi Banka, petitioner no.3 Susa @ Sushanta Pradhan and petitioner no.4 Ranu @ Rani Pradhan. The instruction is taken on record. In view of such submission, since there is no apprehension of arrest of petitioners nos.2, 3 and 4, this anticipatory bail application stands disposed of so far as petitioners nos.2, 3 and 4 are concerned. So far as petitioner no.1 Aiythi Banka and petitioner no.

5 Mahari Banka are concerned, since the Investigating Officer has found materials against them for commission of the offences alleged in the charge sheet and in view of the nature and gravity of accusation, while not inclining to grant anticipatory bail to them, they are at liberty to surrender and move for bail in the Court below within a period of four weeks from today in the event of which the learned Courts below shall dispose of the same in accordance with law.
