01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard Mr. N. Panda, learned counsel for the Petitioner and Mr. D.K. Mohanty, learned ASC appearing for the State-Opp. Party as well as Mr. Satyabrata Panda, learned CGC along with Mr. P.K. Parhi, learned DSGI appearing for the Union of India.
3. The Petitioner has filed the present Writ Petition with the following prayer:- "It is, therefore, most respectfully prayed that your Lordships may graciously be pleased to admit this Writ Petition. Issue notice to the Opposite parties. By considering the facts and grounds stated above a direction may in to the opposite parties GATI how the institution exploite the candidates by spoiling the career of the girl student by wanting the precious time of the petitioner by receiving the money under registration fees and other dues from the petitioner. The registration fees of Rs. 25,500/- and other fees of Rs.5000/- may return soon with interest.
Further the opposite parties may direct to pay the adequate compensation of Rs.3,00,000/- (Rupees Three Lakhs only) as the GATI spoiled the career of the SC/ST girl student failed to provide the commercial
// 2 // pilot training only by wanting the precious time of the petitioner.
Any other or further order this Hon'ble Court may deems fit and proper order in favour of the petitioner.
For this act of kindness the petitioner as duty bound shall ever pray to this Hon'ble Court."
4. However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No.4 by enclosing all the relevant documents and citations in support of her claim, if any, within a period of three weeks hence.
5. It is observed that if such a representation is filed within the aforesaid period, Opp. Party No.4 shall do well to take a lawful decision on the same within a period of three months from the date of receipt of such representation. The order so passed by the Opp. Party No.4 be communicated to the petitioner.
6. With the aforesaid observation and direction, the Writ Petition is disposed of.
