01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard Mr. G.R. Sethi, learned counsel for the Petitioner and Mr. Balabantaray, learned Standing Counsel appearing for the StateOpp. Parties.
3. The Petitioner is aggrieved by the order of dismissal passed on 08.02.2016 vie Annexure-4. This Court after going through the materials available on record finds that the said order of dismissal has been passed in view of the order of conviction and sentence passed against the Petitioner in respect of Cuttack Vigilance P.S. Case No. 3 dtd.12.01.2007.

Since the order of dismissal has been passed in view of the order of conviction and sentence passed in the aforesaid vigilance proceeding, this Court finds no illegality or irregularity in the said order. However, since the Petitioner challenging the said order of conviction and sentence has approached this Court in Criminal Appeal No.552 of 2015, the said order of dismissal shall be subject to the final outcome of Criminal Appeal No. 552 of 2015.

5. The writ Petition is accordingly disposed of. The interim passed earlier stands vacated.
