Heard Mr. J.Sahoo, learned counsel for the Petitioner and Mr. P.Tripathy, learned Addl. Standing Counsel for the State.

The Petitioner is in custody since 28.09.2020 in connection with G.R. Case No. 175(A) of 2017, corresponding to S.T. Case No. 69 of 2017(S.T. No. 70 of 2017) pending in the court of learned Additional Sessions Judge, Aska for the alleged commission of the offence under Sections 341/ 294/ 120(B)/ 302/34 of the IPC., on the strength of NBW issued for his nonappearance by the said court. It is submitted that the petitioner could not appear on the date fixed because of

// 2 // communication gap between him and his lawyer and further undertakes that he shall not default in appearance in future. 4.

Having regard to the submissions as above, the prayer for bail is allowed. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall not default in appearance before the trial court on each date of posting of the case failing which appropriate adverse orders may be passed against him.

5. The BLAPL is disposed of.

6. Urgent certified copy of this order be granted on proper application.
