This matter is taken up through hybrid arrangement Order No.

(virtual/physical mode).

This is the successive journey of the petitioner, who is in custody in connection with Jatni P.S. Case No.126 of 2021 corresponding to G.R. Case No.137 of 2021 pending before the learned J.M.F.C., Jatni running for the alleged commission of offence under sections 457/395, I.P.C. in filing this application under section 439, Cr.P.C. for his release on bail. 3.

Heard learned counsel for the Petitioner and learned counsel for the State.

Taking into account the submissions made; further keeping in view the materials on records as those stand against the petitioner with other surrounding circumstances as also the period of detention of the petitioner in custody and on going

// 2 // through the order passed by the learned ASJ-cum-Special Judge; in the absence of any such impediment; while being inclined to reconsider the prayer for bail of this petitioner; it is directed that the Petitioner be released on bail in the aforesaid case on such terms and conditions as deemed just and proper by the court in seisin of the case with further conditions that he will report before the IIC, Jatni P.S. twice a week i.e. on every Monday & Friday in between 10 am to 02 pm for a period of six months; will appear in person before the court in seisin of the case on each date of posting of the case till conclusion of the trial; and will not indulge himself in any criminal activity. In the event of violation of any of the conditions, it would be open for the prosecution to move for cancellation of bail.

The BLAPL is accordingly disposed of.
