This matter is taken up through Hybrid Order No Arrangement (Virtual/Physical) Mode.

Mr. Dinesh Kumar Panda, learned counsel files vakalatnama in support of his appearance on behalf of the Petitioner by taking no objection from the previous engaged counsel. Vakalatnama be kept on record. Office is directed to delete the name of Mr. R.N. Acharya from the case record as well as from the cause list by indicating the name of Mr. D. Panda.

On the oral prayer made by the learned counsel for the Petitioner, he is permitted to correct the date <29.01.1997= as <29.01.1977= in the prayer portion in Court today.

Heard learned counsel for the parties.

The present Writ Petition has been filed with the following prayer:- <(a) to issue order/direction to the Respondents to sanction and disburse the pensionary benefits to the applicant for the period of his incumbency as LDC in the office of the

// 2 // Respondent No.3 (i.e.

w.e.f 25.04.1967 to 29.01.1977(AN) within a stipulated period.= 6.

Learned counsel for the Petitioner further submits that through highlighting his grievances, the petitioner has filed a representation at Annexure-11 to the Writ Petition before the Opp. Party No.3, but till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.3 to take a decision on the above noted petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.3 to take a lawful decision on the above noted petition in accordance with law within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.
