This matter is taken up through Video Conferencing Mode. 2.

Heard Mr. S.S. Patra, learned counsel for the petitioner and Mr. A.R. Dash, learned Additional Government Advocate. 3.

According to Mr. Patra, the grievance of the petitioner relates to discrimination committed by the Executive Engineer (R & B) Division, Balasore (opposite party no.3) in the matter of paying compensation to him while acquiring his land by purchase. While similar lands acquired by purchase by the opposite party no.3 near petitioner's land have been valued at higher rate resulting in payment of higher compensation, however, so far as petitioner is concerned, no proper valuation has been made and accordingly, he has been paid lesser amount. He further submits that though highlighting his grievances, the petitioner has approached the Collector, Balasore (opposite party No.2) on 8.4.2021 by filing a representation vide Annexure-3, however, till date nothing has been done in the matter. In such background, he prays that a direction be issued to the said opposite party to take a decision on the above noted representation within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Collector, Balasore (opposite party No.2) to take a decision on the above noted representation of the petitioner under Annexure-3 in accordance with law within a period of four months from the date of production of a copy of this order after giving him personal hearing and communicate the result of such exercise to the petitioner.

Accordingly, this writ petition is disposed of. 6.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No. 4587, dated 25th march, 2020, modified by Notice No. 4798, dated 15th April, 2021, and Court's Office Order circulated vide memo Nos. 514 and 515 dated 7th January, 2022.
