1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in apprehension of arrest for his alleged involvement in the offences under Sections 272, 273, 420, 482, 483 & 488/34 of IPC, Section 52, 53 of Orissa Excise Act and Section 51, 52, 53, 57, 63 of Food Safety and Standards Act.

3. Learned Counsel for the State in the meanwhile obtained the upto-date Case Diary and chemical examination report which clearly indicates that the Exts. marked as 'B' is not fit for human consumption as the sample is raw alcohol. He further submitted that the record reveals the present Petitioner is a habitual offender of the similar offences.

4. Keeping in view the submission of the parties, the nature of allegations as emerged from the materials on record, the

// 2 // circumstances appearing, the seriousness and gravity of the offences, this court is not inclined to grant anticipatory bail to the Petitioner. Accordingly the prayer for bail stands rejected and the ABLAPL is dismissed.
