ORDER
28.7.2022 1 1. This matter is taken up through hybrid mode.
2. The writ petition has been registered before this Court on 29.12.2022 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Cuttack.
3. On perusal of the available order sheets of the learned Tribunal it is indicated that notices were issued on 22.6.2016 directing to file counter within four weeks and rejoinder within two weeks thereof.
4. Thereafter the matter was not taken up/pursued nor there is any further pleadings by any of the parties.
5. It is submitted by learned counsel for the petitioner that she has no up-to-date instruction to pursue the matter at present on behalf of the petitioner.
6. The O.A. was filed in the year 2016 by the applicant before the learned Tribunal challenging his non-selection for the post of contract teacher (physical education teacher) pursuant to the advertisement No.2 of the year 2015 issued by O.P. No.2Director of Secondary Education, Odisha.
7. Learned Standing referring to the averments made in the writ petition as well as the counter filed before the learned Tribunal by the D.E.O., Cuttack dated 6.9.2016, submits that the challenge to the selection list for the post of contract teacher (PET) is devoid of any merit as the same was done following the principle of reservation that is 11.25% for SEBC category and out of 39 posts that was advertised, four were meant for SEBC category. It is further submitted that since selection process has been over since 2016, the rights of the selected candidates have crystalised, therefore, nothing would survive for adjudication by this Court.
8. Having heard learned counsel for the parties, the writ petition is disposed of.
