This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel.

This application for bail has been filed by the Petitioner for alleged commission of offence under sections 302,307/34 of the Indian Penal Code.

In the present bail application, the Petitioner calls in question the order dated 04.10.2021 passed in B.A.No. 218 of 2021 by the leaned Additional Sessions Judge, Malkangiri. However, in the meantime several months have been passed and the investigation has been completed. In the meantime, learned counsel for the Petitioner seeks liberty of this Court to withdraw this matter with liberty to approach the trial court by filing fresh bail application. 5.

Accordingly the BLAPL is disposed of as withdrawn with liberty to file a fresh application before the learned trial court. In the event a fresh bail application is filed, the same shall be considered in

With the aforesaid observation, the BLAPL stands disposed of. 7.
