Heard Mr. J. Mishra, learned Counsel for the Petitioner and Mr. A.K. Mishra, learned Additional Government Advocate for the State.

The Petitioner has filed this Writ Petition seeking direction to the Opposite Parties to grant notional promotion and financial benefit to the post of Section Officer, Level-I with effect from 27.04.2013.

In response to the notice, Counter Affidavit has been filed by the Opposite Parties 1 and 2, wherein it has been contended that before another DPC meeting could be convened to take a decision for giving promotion to the petitioner to the rank of Section Officer, Level-I, the Government in Finance Department issued Resolution No. 26274 dated 08.08.2013 in which the post of Section Officer Level-I and Level-II merged to one post of Section Officer. Therefore, it is not possible to give promotion to the Petitioner. Besides the same, it is also indicated that the Government in

Revenue and D.M. Department vide letter dated 10.03.2017 have reiterated that there is no question of promotion of the Petitioner from Section Officer Level-II to Section Officer Level-I after 01.01.2013 as there is no existence of such post after 01.01.2013. 5.

In view of the above, the relief sought by the Petitioner cannot be granted and, as such, the Writ Petition stands dismissed. Arun (DR. B.R. SARANGI) JUDGE
