Heard learned counsel for the Parties.

Considering the objection to the impugned order by the learned counsel for the Petitioner and on perusal of the impugned order appears to have been passed in 2017, this Court finds, there is technical rejection of the Appeal under Section 22(2) of the O.S.S. Act on the sole premises of the Petitioner failing to substantiate his case and production of material evidence. For technical rejection of the Appeal, for the opinion of this Court, nothing prevented the Petitioner to move an Appeal again but however in the involvement of any material evidence available in his favour to support his case. 3.
