It is contended by learned counsel for the parties that consequent upon amendment to the provisions of Section 10-A(2)(b) of the Mines and Minerals (Development and Regulation) Amendment (MMDR) Act, the vires of the said amended provision is under challenge before the apex Court in T.P. No. 329-377 of 2022, which is pending adjudication.

In that view of the matter, liberty is granted to the petitioner to pursue his remedy before the appropriate forum, if he is so advised. 5.
