1. 1. This matter is taken up by hybrid mode.

2. The writ petition has been registered before this Court on 16.12.2021 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack.

3. On perusal of the available order sheets of the learned Tribunal it is indicated that notices were issued on 7.05.2015 and the matter was never taken up/pursued after 8.11.2016.

4. Original Application was filed in the year 2015 by the petitioners who were then working as apprehending disengagement of the service of the petitioner as driver in the office of Director of Industries, Odisha (O.P. N.2). It is submitted by learned counsel for the petitioner that he has no up-to-date instruction to pursue the matter at present.

5. It is submitted by learned AGA referring to the counter dated 24.5.2016 filed on behalf of O.Ps. that since the post of driver is to be filled up by regular recruitment, the petitioner could have very well participated in selection process. It is specifically submitted referring to paragraph-6

of the counter that no other person has been engaged as driver after disengagement of the petitioner.

6. Having heard learned counsel for the parties, the writ petition is disposed of observing that in case of any future requirement of driver to be engaged as daily wage, the petitioner shall be considered sympathetically in view of his experience.
