Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Special G.R. Case No.135 of 2022, pending in the file of learned ADJ-cum-Special Court POCSO Cuttack, arising out of Markatnagar P.S. Case No.189 of 2022, for commission of alleged offences under Sections 448/376(3)/376(2)/376(2)(n) of IPC read with 6 of POCSO Act. 3.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned ADJ-cum-Spl. Court under POCSO Act I/C, Cuttack by order dated 18.10.2022 in the aforementioned case, the present BLAPL has been filed. 4.

Learned counsel for the petitioner seeks permission to withdraw this bail application with liberty to move the learned Court in seisin post charge sheet.

Giving such liberty, the bail application stands disposed of. 6.

It shall be open to the petitioner to move the learned Court in seisin over the matter after filing of charge sheet and same shall
