This matter is taken up by virtual/physical mode. 2.

The Original Application No.1385 of 2015 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No.1385 of 2015.

The Petitioner has filed the writ petition with a prayer to direct the Opposite Parties to allow her to be engaged in the post of Jr. Matron for which she had applied pursuant to advertisement dated 10.11.2014 at Annexure-4. The District Welfare Officer, Angul (Opposite Party No.2) has issued a letter dated 16.02.2015 instructing the Petitioner to produce original certificate and other documents for verification on 24.02.2015.

It is contended by Mr. Biswal, learned counsel for the Petitioner that the said communication is stated to have been sent by post on 21st February, 2015, which is apparent from the postal receipt (Annexure-7). He asserted that the said communication was served on the Petitioner on 25.02.2015 which is manifest from the

// 2 // document at Annexure-8, i.e., endorsement of Branch Office at Urukula.

It transpires from Annexure-8 that the Branch Office at Urukula received the registered letter on 24.02.2015 and delivered in the address of the Petitioner on 25.02.2015. It is alleged by the counsel for the Petitioner that in spite of several approached to the Opposite Parties, the authorities paid no heed. The Petitioner approached the learned Odisha Administrative Tribunal in O.A. Though the learned Tribunal had directed for filing of counter vide order dated 4.5.2015, no counter has been filed. 6.

Heard learned counsel for the parties.

Since the matter is of the year 2015 and granting further time to file counter, no fruitful purpose would be served. Therefore, the writ petition is disposed of with a direction to the Opposite Party No. 1 i.e. Collector, Angul to verify the veracity of the contention raised by the Petitioner. For this purpose, the Petitioner is directed to approach the Opposite Party No. 1 within two weeks from today and produce the certified copy of this order along with the documents relied on to show that the communication was received by the Petitioner after the date scheduled in the communication. The Opposite Party No. 1 is directed to take a decision after affording an opportunity of hearing to the Petitioner within a period of four weeks from the date of receipt of documents from the Petitioner and pass reasoned order which shall be communicated. The entire exercise should be completed within a period of two months.
