This matter is taken up by virtual/physical mode. 2.

The Original Application No.1342 of 2015 was filed before the Orissa Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No.1342 of 2015.

None appears for the Petitioner when the matter is called. 4.

Heard Mr. Prasanna Kumar Mohanty, learned Addl. Standing Counsel.

The Petitioner, though has not challenged any specific order, submits that on attaining 50 years of age, he has taken voluntary retirement on 31.03.2012 and complied with the provisions contained in Rule 41(1) of Odisha Civil Service (Pension) Rules, 1992. However, no pensionary benefit has been made available to him in spite of several requests made before the authority concerned.

Mr. Mohanty, learned Addl. Standing Counsel points out that since the matter is of the year 2015 and by now the grievance of the Petitioner ought to have sorted out and the matter has been rendered infructuous.

In view of the above, the writ petition is dismissed granting liberty to the Petitioner to revive the petition within a period of 90 days from today, if any cause of action still survives. Issue urgent certified copy as per rules.
