3. The Petitioner has filed the present writ petition with the following prayer.
To direct the Respondent No.3 to appoint the applicant for the post of MPHW(F) under C.D.M.O, Ganjam with seniority w.e.f 8.2.2014 from the date of vacancy To direct Respondent No.3 the appointment order would be issued in favour of applicant in place of Manjuta Das who did not join to the above mentioned post.
4. It is submitted that the petitioner even though pursuant to the advertisement issued under Annexure-4 was declared qualified, but she was not provided with the appointment and accordingly the present writ petition has been filed.

Mr. Mishra, learned A.G.A on the other hand submitted that the claim of the petitioner has been forwarded to the CDMO, Ganjam-Opp. Party No.3 vide letter dated 8.12.2004 of the Opp. Party No.2 with a request to consider the claim of the petitioner for her appointment as MPHW(F).
Since it is submitted that no decision has been taken by the Opp.
Party No.3 on the communication made by Opp. Party No.2-Director of Health Services, Odisha on 8.12.2014 under Annexure-9 series, this Court while disposing the Writ Petition directs Opp. Party No.3 to take a decision on the claim of the petitioner for her appointment within a period of one month from the date of receipt of this order. It is however observed that this Court has expressed no pinion on the merits of the case.
