This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State-Opposite Parties.

The present writ petition has been filed by the Petitioner with the following prayers:
"Under such circumstances, it is therefore prayed that your Lordships would be graciously pleased to admit this writ application, call for records and after hearing the parties may be pleased to issue a writ(s), order(s), direction(s) in the nature of mandamus directing the opposite parties to sanction pension and other benefits at par with other similarly situated persons already been availed the benefits from the Govt. within a stipulated period as this Hon'ble court deems just and proper. And further may pass any other order(s) and direction(s) as this Hon'bel court fit proper." 4.
It is submitted by learned counsel for the Petitioner that although the Petitioner has filed representation dated 17.09.2014
// 2 // before the Secretary to Government of Odisha, Water Resources Department, Rajiv Bhawan, Bhubaneswar with a copy thereof communicated to the Opposite Party No.3-Chief Engineer, Basin Manager, Brahmani Right Basin, Dhenkanal under Annexure-3, but the same is still pending before the said Opposite party and the said Opposite Party has not taken any decision as of now. 5.
Learned counsel for the State submits that he has no objection, if a direction is given to the authority concerned to consider the representation of the Petitioner in accordance with law within a stipulated period of time.

Considering the submissions made by the respective parties and without expressing any opinion on the merits of the case, this Court disposes of the writ petition at the stage of admission with a direction to the Opposite Party No.3 to consider the representation of the Petitioner dated 17.09.2014 under Annexure-3 keeping in view the law laid down by this Court in W.P.(C) No.8371 of 2022 decided on 16.05.2022 by passing a speaking and reasoned order within a period of eight weeks from the date of production of certified copy of this order. The Petitioner is directed to approach the authority along with the certified copy of this order passed in W.P.(C) No.8371 of 2022. Any decision so taken on the said representation shall be communicated to the Petitioner within a period of two weeks thereafter.

Urgent certified copy of this order be granted on proper application.
