This matter is taken up through virtual/physical mode. 2.

The Original Application No. 1398 of 2015 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 1398 of 2015.

The Petitioner assailing the select list dated 16th April, 2015 published by the Opposite Party No.2(State Selection Board, Odisha Police) in connection with the appointment of Constable in Police Commissionerate, Cuttack-Bhubaneswar, the Petitioner has claimed that certain candidates who secured less marks have been selected, whereas the Petitioner was ignored. The Odisha Administrative Tribunal vide order dated 22nd April, 2015 passed the following interim order:- "So far as the prayer for interim order is concerned, appointment of the candidates vide Annexure-6, the select list, shall be subject to the result of the O.A. and in the event the applicant succeeds in the O.A. the last candidate appointed in the S.T.(W) category shall make way for the applicant for

// 2 // her appointment and such stipulation be reflected in the appointment order of the candidate"

Heard Mr. L.P. Dwivedy, learned counsel for the Petitioner and Mr. P.K. Mohanty, Additional Standing Counsel.

The counter affidavit has come to be filed by the Opposite Parties. At the time of hearing today, the Mr. L.P. Dwivedy, learned counsel for the Petitioner submitted that by efflux of time the matter has become infructuous. 6.

Accordingly, the writ petition stands dismissed as infructuous.
