This matter is taken up through Video Conferencing mode. 2.

Heard learned counsel for both the parties.

The sole grievance of the Petitioner in the present writ petition is that although he had applied for appointment under the Rehabilitation Assistance Scheme, the same has not been considered by the District Education Officer, Kendrapara, Opposite Party No.3 till date.

It is submitted by learned counsel for the Petitioner that his late father Jagannatha Dalai was working as a Peon in Taras High School, Kendrapara and while working as such, he died in harness on 19.4.1994. It is further submitted by learned counsel for the Petitioner that he had submitted a representation dated 7.6.2021 (Annexure-9) which is pending before the District Education Officer, Kendrapara, Opposite Party No.3 and prays for direction to the Opposite Party No.3 to consider his representation within a stipulated period of time.

Learned counsel for the School and Mass Education Department submits that he has no objection if a direction is given to consider his representation in accordance with law. 6.

Having heard learned counsel for the parties, this Court disposes of the writ petition with a direction to Opposite Party No.3 to consider the representation dated 7.6.2021, if any pending before him, within a period of eight weeks from the date of production of authenticated copy of this order. It is needless to mention here that the representation of the Petitioner shall be considered and disposed of by passing a speaking and reasoned order. It is made clear that this Court has not expressed any opinion on the merits of the case. 7.

As the restrictions due to resurgence of COVID -19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Court's Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
