01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. Sinha, learned counsel for the Petitioner and learned counsel for the State.

3. The present writ Petition has been filed with the following relief:- "In view of the facts started above the applicant prays that the Hon'ble Tribunal may graciously be pleased to quash the entire departmental proceeding as well as the second show notice issued by the respondent no. 1 on 24-02-2015 (annexure-6;

And further be pleased to direct the respondent to treat the period of suspension as duty and to extend all service and financial benefits retrospectively;"

4. This Court while issuing notice of the matter vide order dtd.02.04.2015 had observed that if any order is passed in the

// 2 // proceeding after submission of show cause, then the Petitioner will be at liberty to approach this Court.

5. It is submitted by Mr. Das that the Petitioner has already filed the show cause. In view of such submission made by the learned counsel appearing for both the Parties, the writ Petition is disposed of with a direction on the sole Opp. Party to finalize the proceeding, if it has not yet been finalized in the meantime within a period of three (3) months from the date of receipt of this order. It is observed that this Court has not expressed any opinion on the merits of the case.
