Heard learned counsel for the Parties.

In course of hearing this Court finds difficulty in entertaining the relief involved herein as the dispute already entered into the land acquisition proceeding as established on the own documents of the Petitioner. Through Annexure-6, it appears, Petitioner instead of approaching the competent authority making at least a request for diversion of the project taking land in required proportionate for the Petitioner. Taking into consideration the request of the Petitioner who is ready to sacrifice its own land for the purpose, this Court here finds, Petitioner making such surprise ground in filing the Writ Petition instead of making similar approach to the competent authority at least for their consideration.

In the event the Petitioner is having the particular difficulty in maintenance of industrial unit involving herein and working out of the land involving the land acquisition proceeding vide Annexure-5, it may be open to the Petitioner to make approach to the land

// 2 // acquisition authority for considering the possibility for diversion of the project as the request will also involves sacrificing of Petitioner's land only.

In the event any such application is made within seven days at least required exercise shall also be undertaken in the involvement of the Petitioner involving Annexure-5.
