Heard Mr. S.K. Nanda, learned counsel appearing for the petitioner.

The petitioner has filed this writ petition seeking to quash the order dated 23.09.2022 under Annexure-9, by which the tender for the work "completion of Kalyan Mandap (First Floor) behind Municipality Office, Sundargarh" invited vide notice no.5862 dated 02.06.2022 and bid reference no.SNGM-03/2022-23 has been cancelled.

Mr. S.K. Nanda, learned counsel appearing for the petitioner contended that the petitioner is a "C" Class SC contractor and, as such, she is a lady. Therefore, the work should have been allotted in her faovur but, instead of that, the same has been cancelled on the ground of single bidder. 5.

Having heard learned counsel for the petitioner and after

going through the records, it appears that the Executive Officer, Sundargarh Municipality invited a tender for the work "completion of Kalyan Mandap (First Floor) behind Municipality Office, Sundargarh" vide notice no.5862 dated 02.06.2022 and bid reference no.SNGM-03/2022-23. Since the petitioner was the single valid bidder, the tendering authority cancelled the tender, vide order dated 23.09.2022 under Annexure-9, which is legally unjustified. Therefore, this Court does not find any error apparent on the face of the records so as to cause interference of this Court. 6.

Accordingly, the writ petition merits no consideration and the same is dismissed.
