This WPC (OAC) has been filed by the Petitioner for the following relief(s) :- (i) To direct the respondents to count the service of the applicant rendered as resource teacher from 2.9.1991 to 1.12.1995 for the purpose of seniority.

(ii) To direct the respondents to release the salary of the applicant from 1.5.1993 to 1.12.1995.

Mr. N. Jena, learned Standing Counsel for the School & Mass Education Department submits that the Petitioner is not entitled to any of the relief(s) sought for by him, as he was appointed in a schematic job sponsored by the Central Government and he was not initially appointed by the School & Mass Education Department.

Mr. G.R. Sethi, learned counsel appearing on behalf of the Petitioner however submits that without going to the merit of the claim of the Petitioner, the representation filed by the Petitioner vide Annexure-5 before the Block Education Officer, Nuagaon in the district of Nayagarh be directed to be disposed of. 6.

Regard being had to such facts and submission, this WPC (OAC) is disposed of directing the Block Education Officer, Nuagaon in the district of Nayagarh to dispose of the representation of the Petitioner vide Annexure-5 in accordance with law, by passing a speaking order within three months from the date of receipt of a copy of this order.

The Petitioner is directed to supply the certified copy of this order along with a copy of the Writ Petition containing all the Annexures to the Block Education Officer, Nuagaon for convenience and reference to Annexure-5.

Urgent certified copy of this order be granted as per rules. ........................
