Heard learned counsel for the Parties.

The dispute involves alleged illegal rejection of the candidature of the Petitioner involving the advertisement, vide Annexure-1.

There is no dispute that there has been already conclusion of interview involving the advertisement, vide Annexure-1 long since. It is at this stage of the matter, looking to the nature of interim order passed by the Tribunal, this Court finds, the Tribunal directed that any appointment made against the post in Physically Handicapped category would be subject to the result of the Original Application. For the undisputed fact that there is appointment pursuant to the interview over long since and the Petitioner has failed in obtaining

// 2 // an order from the Tribunal to at least appear and his appearance in such interview would have continued dependent on finality in the litigation. This Court finds, there cannot be another interview for the present Petitioner after so many years and thus the matter becomes academic. In the circumstance, this Court finds, there cannot be any further progress involving the dispute raised herein. 4.

For the examination already over long since and in absence of any specific interim order permitting the Petitioner to appear the interview conditionally, this Court is not inclined to entertain the Writ Petition, which stands dismissed accordingly. (Biswanath Rath) Judge M.K.Rout
