Heard learned counsel for the Parties.

Order No.

The Writ Petition involves the following prayer :- "It is, therefore, prayed that this Hon'ble Court be graciously pleased to Issue Rule Nisi calling upon the Opposite Party to show cause as to why an appropriate writ in the nature of certiorari/mandamus and/or any other appropriate writ/writs or order/orders or direction shall not be passed to execute the lease deed in favour of the Petitioner in respect of the Plot No.K-7-113 of Kalinga Vihar.

If the Opp.Party authority fails to show cause or show insufficient cause, the above rule nisi be made absolute.

And/or order/orders as this Hon'ble Court may deem just and proper in order to provide the Petitioner complete relief."

There is no dispute at the Bar that the Petitioner's case is available to be considered keeping in view the observation and

// 2 // direction of this Court in disposal of W.P.(C) No.12489/2022. Keeping in view the above, this Court in disposal of the present Writ Petition directs the Development Authority involved herein to consider the request of the Petitioner pending with it strictly in terms of the judgment in W.P.(C) No.12489/2022 passed on 12.10.2022 and complete the entire exercise within a period of two months from the date of communication of this order by the Petitioner. This direction is however provided the Petitioner meets with other eligibility criteria, if any, fixed by the Development Authority. This Court records the Petitioner's undertaking to cooperate with the Authority in meeting with any other eligibility criteria requirement suggested, if any.
