The petitioner has filed this writ petition seeking direction to the opposite parties to give him promotion to the post of Odisha Revenue Service (ORS) Group-B from the date others got promotion as per Annexure-5 series and grant all other financial and consequential benefits in his favour. 4.

Mr. P.K. Muduli, learned Additional Government Advocate appearing for the State-Opposite Parties referring to counter affidavit contended that the petitioner is not entitled to get the benefit, as claimed in the writ petition. 5.

Perused the counter affidavit. It appears that the petitioner was not eligible for recommendation to promotion of Odisha Revenue Service (Group-B) for the recruitment

year 2011 as he was not considered having outstanding merit and ability. It is also stated that opposite party no.3 had gone through the complete CCRs of the petitioner carefully and on the basis of entries made therein, did not consider the petitioner suitable for promotion to Odisha Revenue Service (Group-B) by way of promotion for the recruitment year 2011, as he did not have five outstanding CCRs for the preceding five years as per the guidelines prescribed by the Board of Revenue, Odisha.

In view of such position, this Court does not find any illegality or irregularity committed by the authority in not promoting the petitioner to the post of Odisha Revenue Service (ORS) Group-B. Accordingly, the writ petition merits no consideration and the same is dismissed. Alok (DR. B.R. SARANGI) JUDGE
