Petitioner is one of the LRs and successor in interest of a residential property, which was offered as a collateral security for raising a Housing Loan for a sum of Rs.4 Lakhs by his late father Sk. Fakir Mohammad from Punjab National Bank, Pipili Branch, District-Puri, which was put for auction sale on 25th March, 2022 vide a Sale Notice dated 4th March, 2022 (Annexure-2) towards the outstanding liability in the said account. It is the Sale Notice, which is the subject matter of challenge before this Court.

At the time of hearing, learned counsel for the petitioner submits that the auction fixed for the said date has failed and therefore, the present Writ Petition
// 2 // has become infructuous. He further states that the petitioner in compliance of the letter issued by the Bank has tendered his proposal for an amicable settlement under the One Time Settlement (OTS), which is stated to be pending.

In view of the above, the present Writ Petition stands dismissed as infructuous.
The petitioner is free to pursue his available remedies in accordance with law.
