This matter is taken up through virtual/physical mode. 2.

The Original Application No. 1037 of 2015 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 1037 of 2015.

The Petitioner challenged the seniority in Jr. S.E.S. Cadre upon merger of Trained Graduate Teachers of both the Old Government High Schools and New Government High Schools and sought for pay protection as Headmaster. 4.

Heard Mr. N. Sarkara, counsel for the Petitioner and Mr. R.C. Pattnaik, Standing Counsel for the School and Mass Education.

Mr. N. Sarkara, counsel for the Petitioner submitted that he has no instruction in the matter as such he prays for disposal of the writ petition with liberty to file afresh if cause of action still survives.

Since this matter is pending since 2015, by influx of time the matter has been rendered infructuous. Hence, this writ petition is dismissed with liberty to the Petitioner to revive the petition within 90 days from today in case cause of action still subsists.
