Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel Mr. D. Mishra & Associates have entered appearance on behalf of the informant/victim. Vakalatnama filed on behalf of the informant/victim is taken on record. Name of Mr. D. Mishra & Associates be reflected in the file, in the cause list as well as in the CMS of this Court.

The petitioner is an accused in connection with C.T. Spl. (POCSO) Case No.100 of 2022, pending before the learned Additional Sessions Judge-cum-Special Judge, Jajpur, arising out of Tomaka P.S. Case No.91 of 2022, for alleged commission of offences under Sections 363/366/376(3)/376(2)(n)/506/109 of IPC read with Section 4(2)/6 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge-cum-Special Judge (POCSO), Jajpur by order dated 13.10.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the State, on instruction, submits that the petitioner has 17 criminal antecedents including one under Section 498(A)/34 of IPC read with Section 4 of D.P. Act. 6.
Considering the nature of allegations and the criminal antecedents of the petitioner, this Court is not inclined to entertain this bail application on the second journey of the petitioner to this Court.

It shall be open to the petitioner to renew his prayer before the learned Court in seisin after examination of the victim. 8.
Accordingly, the BLAPL stands disposed of.
