Md. Modani, learned advocate appears on behalf of petitionerOrder No. husband and submits, opposite party-wife has filed for maintenance under chapter IX of Code of Criminal Procedure, 1973 before Family Court, Bhubaneswar. The marriage was solemnized at Bhadrak and parental home of opposite party-wife is in Kendrapara. As such, his client seeks transfer of the maintenance case to Family Court, Bhadrak or Kendrapara.

He points out there is report by Stamp Reporter saying that the petition should be registered as TRP(CRL).

It appears that the petition has been incorrectly registered since it relates to transfer of criminal proceeding. This Bench has assignments of CMP, CRLMP and all civil matters. TRP(CRL) does not come under the assignments.

The petition be released from the list for registration to be rectified and placed before the Bench having assignment. (Arindam Sinha) Judge Prasant
