Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.90 of 2022, pending in the file of learned Additional Sessions Judge-cumSpecial Court (POCSO) Bhawanipatna, arising out of Koksara P.S. Case No.212 of 2022, for commission of alleged offences under Sections 341/294/354-A/506/34 of IPC read with Section 8 of the POCSO Act.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpl. Court under POCSO act, Bhawanipatna by order dated 18.10.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that the petitioner is in custody since 09.09.2022 and charge sheet has been filed on 17.10.2022. Hence, he may be released on bail.

Perused the 161 Cr.P.C. statement of the victim which is on record.

Considering the age of the petitioner and period of custody and filing of charge sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
