None appears for the Petitioner at the time of Call. Heard Mr. A.K. Mishra, learned Additional Government Advocate. Perused the record. 3.

The Petitioner has filed this Writ Petition seeking direction to the opposite parties to provide appointment to the petitioner in the post of driver under rehabilitation assistance scheme. 4.

Pursuant to the notice issued by this Court, Opposite Party No.4 has filed the Counter Affidavit, wherein it has been stated that "after death of Late Surendra Mohapatra, his legal heirs left were Ujala Mohapatra, (wife), Smt. Sukanti Jena (daughter) and Sri Susanta Mohapatra (son). His wife and daughter through an affidavit had furnished their unwillingness to apply under rehabilitation scheme, but his son Sri Susanta Mohapatra had applied for his appointment, But he did not apply within the stipulated time limit of one year and rather applied long after the stipulated time limit and presently the decision is pending for disposal before the Govt". 5.

Since the application filed by the petitioner was beyond the prescribed time limit, therefore, the claim made by the Petitioner at the belated stated cannot sustain.
