This matter is taken up through hybrid arrangement (virtual/physical mode).

This the successive journey of the Petitioners, who are in custody in connection with Bamebari P.S. Case No.103 of 2019 corresponding to S.T. Case No.04 of 2020 (G.R. Case No.486 of 2019) on the file of learned Additional Sessions Judge, Champua running for commission of offence under sections 302/120-B/323/34 of the IPC read with section 4 of the Odisha Prevention of Witch Hunting Act, in filing this application under section 439 of the Cr.P.C., have prayed for their released on bail.

Heard learned counsel for the Petitioners and the learned counsel for the State.

Keeping in view the submissions made, the record being perused, it is seen that the Petitioners had last moved the Trial Court on 18.10.2021 for their release on bail and by then, twelve prosecution witnesses having already been examined, the case was posted to 08.11.2021 & 09.11.2021 for further evidence.

In view of all these above, this application stands disposed of granting liberty to the Petitioners to renew their prayer for grant of bail before the Trial Court citing all such developments, which have taken place in the meantime for their consideration in proper perspective.

It is needless to observe that in the event, such a move is made, the Trial Court would do well to consider the same on its own merit; further taking into account all such developments, which have taken place in the meantime in their proper perspective and dispose of the same early in accordance with law.
