Heard Mr. N. Lenka, learned counsel for the petitioner and Mr. Y.S.P. Babu, learned A.G.A 3.
The present writ petition has been filed challenging the impugned notice dated 27.9.2016 under Annexure-6. This Court after going through the same finds that the said notice has been issued in view of the order of conviction and sentence passed against the petitioner in Balasore Vigilance P.S. Case No.5 of 2009. It I also found from the record that challenging the said order of conviction and sentence, the petitioner has approached this Court in Crl. Appeal No.104 of 2016 and this Court while admitting the matter has not passed any order staying operation of order of conviction and sentence.

In view of such admitted position, this Court finds no illegality or irregularity in the impugned order dated 27.9.2016 under Annexure-6 and accordingly is
// 2 // not inclined to entertain the Writ Petition. However, The order dated 27.9.2016 passed under Annexure-6 shall be subject to the final outcome of the Crl. Appeal No.104 of 2016.
