This matter is taken up through virtual/physical mode. 2.
The Original Application No.199 (C) of 2016 was filed before the State Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No.199 of 2016.

The Petitioner challenges the order dated 29.12.2015 passed by the Superintendent of Police, Bargarh wherein the representation of the Petitioner had been rejected. The order so passed by Superintendent of Police directed for continuance of enquiry proceeding by way of the writ petition, the Petitioner sought for a direction to the Opposite Parties to stay the initiation of disciplinary proceeding till disposal of the criminal case bearing V.G.R. Case No.78 of 2014 arising out of Sambalpur Vigilance P.S. Case No.90 of 2014 pending in the Court of Special Judge, Vigilance, Sambalpur.

None appears for the Petitioner at the time of call.

There is no quarrel about the position that the criminal case and disciplinary proceeding can go on simultaneously. 6.
By efflux of time, the writ petition has been rendered infructuous.

Accordingly, this writ petition stands dismissed as infructuous.
