01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

3. The Petitioner has filed the present Writ Petition with the following prayer:- " In view of the facts stated in para 6 above, your Lordships may be pleased toi) To direct the respondents to grant all financial and consequential benefits from the date of initial appointment i.e from 23.10.2010.

ii) To direct the respondents to fix his pay and other allowances treating his date of appointment as 23.10.2010.

iii) To direct the respondents to release the arrear salary of the applicant.

iv) And pass such other order/orders as may be deemed fit and proper for the interest of justice."

Considering the submission made and without expressing any opinion on the merits of the case, the Petitioner is directed to make a fresh representation before the Opp. Party No.2 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three weeks hence.

It is observed that if such a representation is filed within the aforesaid period, the Opp. Party No.2 shall do well to take a lawful decision on the same within a period of three months from the date of receipt of such representation. It is however observed that while taking a decision on the claim of the Petitioner, the said Opp. Party shall take into consideration the order passed by the learned Tribunal under Annexure-5 and the benefit extended in favour of similarly situated persons as indicated in Para 6.18 of the brief. The order so passed by the Opp. Party No.2 be communicated to the Petitioner.

With the aforesaid observations and directions, the Writ Petition is disposed of.
