Heard learned counsel for the Parties.

Even though learned counsel for the Petitioners submits that there is pendency of demarcation proceeding involving the disputed land involved herein, this Court however through the entire pleading does not find any pendency of demarcation proceeding for disposal of the same in absence of concrete materials establishing pendency of a demarcation proceeding. This Court in disposal of the Writ Petition observes in the event any demarcation case being moved by the Petitioner is already registered by the Tahasildar, Shamukhunta, the same may be disposed of in accordance with law but however providing opportunity to all parties likely to be affected. 3.

The Writ Petition thus stands disposed of.
